Limo Safety and Licensing in New Zealand
The rules every Auckland limo service must follow, what they mean for passengers, and what to check before you book.
Updated
Every limo you hire in New Zealand is a commercial passenger service, so it runs under the same Waka Kotahi NZ Transport Agency rules as taxis and shuttles. This guide explains what those rules require, what they mean for you as a passenger, and what to check before you book a limo for a wedding, school ball or night out in Auckland.
The operator must hold a Small Passenger Service licence
Any business that carries paying passengers in a vehicle seating 12 or fewer people needs a Small Passenger Service (SPS) licence from Waka Kotahi. Stretch limousines fall under this. The licence holder is responsible for checking that its drivers are properly endorsed, that its vehicles are certified, and for keeping records of those checks and of any complaints.
The chauffeur must hold a P endorsement
A chauffeur driving for hire needs a passenger (P) endorsement on their licence. To get one, a driver must:
- have held a full New Zealand driver licence for at least two years
- pass a “fit and proper person” check, which includes a Police check, and keep passing ongoing checks while the endorsement is current
- drive only for a licensed passenger service
The driver must also display a Waka Kotahi driver ID card in the vehicle. If you are a parent booking for a school ball, you are entitled to see it.
Every limo needs a Certificate of Fitness
Passenger service vehicles need a Certificate of Fitness (CoF) rather than a standard Warrant of Fitness. A CoF inspection is more thorough and checks the vehicle’s structure, brakes, seatbelts and seating for carrying paying passengers. The current CoF label is displayed on the windscreen.
Chauffeurs have work-time limits
All small passenger service drivers must take a rest break after 7 hours of continuous work and record their hours in a logbook. For most limo bookings this makes no difference, but for a long wedding day or an all-day winery tour, ask how the booking is staffed.
The price is agreed before the trip
The law requires the fare basis to be agreed with the hirer before the trip, and the driver cannot charge more than what was agreed. For limo hire this is your written quote. Read it for what is included, how extra time is charged, and any cleaning or damage terms before you confirm.
Seatbelts and child seats
Passengers aged 15 and over are responsible for wearing their own seatbelt. For children, the national rules are:
| Age | Rule |
|---|---|
| Under 7 | Must use an approved child restraint. In a passenger service vehicle, if no suitable restraint is available, the child must still use a seatbelt where one is fitted. |
| 7 to 8 | Use an approved child restraint if one is available, otherwise a seatbelt. |
| 8 to 14 | Seatbelt where available. |
If young children are travelling, for example a flower girl or page boy at a wedding, say so in your quote request so a suitable seat can be arranged, or bring your own.
Alcohol and under-18s
It is illegal to supply alcohol to anyone under 18 unless you are their parent or guardian or have their parent or guardian’s express consent, and even then it must be supplied responsibly. The fine is up to $2,000. For school balls, the simplest approach is an alcohol-free limo. Our guide to drinking in a limo in Auckland covers the rules for adult bookings, including Auckland’s alcohol ban areas.
Checklist before you book
- Ask the operator to confirm they hold a current Small Passenger Service licence
- Check the chauffeur’s Waka Kotahi ID card is displayed on the day
- Look for a current Certificate of Fitness label on the windscreen
- Get the price, inclusions and extra-time rate in writing
- Tell the operator about any children who need a car seat
- For school balls, agree pickup and drop-off addresses and times with the other parents
For school ball planning, see the parents’ guide to school ball transport. Rules summarised from Waka Kotahi NZ Transport Agency, the Ministry of Justice and Auckland Council guidance. This page is general information, not legal advice.
Questions
Do limos in New Zealand need a licence?
Yes. A business that carries paying passengers in a vehicle seating 12 or fewer people, including a stretch limo, needs a Small Passenger Service licence from Waka Kotahi NZ Transport Agency.
What licence does a limo chauffeur need?
A full New Zealand driver licence held for at least two years plus a passenger (P) endorsement, which requires a fit and proper person check including a Police check. The driver must display a Waka Kotahi ID card.
Do limos need a Warrant of Fitness?
No. Passenger service vehicles need a Certificate of Fitness, a more thorough inspection than a Warrant of Fitness.
Do children need a car seat in a limo?
Children under 7 must use an approved child restraint where one is available. In a passenger service vehicle without a suitable restraint, they must still wear a seatbelt. Mention children in your quote request so a seat can be arranged.
Can school ball students drink in the limo?
Supplying alcohol to under-18s without express parental consent is illegal, with fines up to $2,000. An alcohol-free limo is the simplest and safest option for school balls.
